중국 사법개혁은 1978년 중국 공산당 제11차 삼중전회에서 중국 법제와 사법에 대한 개혁이 시작되어 1980년대를 거쳐 1990년대 중반까지 재판방식 중심의 개혁이 이루어졌다. 2000년 초반까지는 중국 법원과 검찰의 개혁과 관련하여 전 방위적 사법개혁이 진행되었으며 이후 2013년까지 사법체제에 대한 개혁이 시도되었다. 최근 2014년에는 법치에 대한 전면적인 추진을 목표로 독립적인 재판, 검찰권 행사의 보장제도 개선, 대중이 참여하는 사법, 사법 활동에 대한 감독강화, 인권의 사법보장 강화 등이 강조되고 있다. <이하 원문 확인>

중화인민공화국 형법은 1949년 중화인민공화국 건립부터, 국가는 곧 형법전의 기초와 준비작업을 시작하였고, 1954년부터 1979년까지 30년의 시간 동안 38회의 수정작업을 거쳐 마침내 1979년 제5회 전국인민대표대회 제2차 회의에서 통과된, 최초의 통일된 사회주의형법전으로, 1980년 1월 1일 부터 실행되어 범죄예방과 인민보호의 역할을 하였으나 개방개혁과 사회주의시장경제건립에 따른 새로운 문제가 발생으로 형법전의 수정과 보충이 불가피해졌다. 1981년부터 시작하여, 전국인민대회 상임위원회는 이에 부응하여 23개의 수정형법결정과 보충규정을 제정하였고, 90개 부문의 경제법, 행정법에서 형법에 의하거나 참조하는 조문 130여개를 규정하여 형사책임을 추궁하는 규정을 마련하였다. 또한, 전국인민대회상임위원회 법률공정위원회는 1982년부터 15년간 형법의 수정작업과 연구, 오랜 준비를 거쳐 마련된 형법수정초안을 전국인민대회상임위원회, 전국인민대표대회가 3단계 심사를 하고 1997년 3월 14일에 제8회 전국인민대표대회 제5차 회의에서 심의를 거쳐 1997년 10월 1일에 실행하게 되었다. 이 형법은 통일된 형법으로, 비교적 완비된 법전이라 할 수 있다. 이번 수정한 형법은 널리 의견을 듣고 각계 의견을 수렴한 기초로 제3조부터 제5조까지는 3개항의 기본원칙을 명확히 규정하였다. 즉: 죄형법정원칙, 형법의 사람에 대한 평등원칙, 죄·책임·형벌 상응원칙으로, 중국형법에서 기본원칙상 "죄형법정"의 사상을 명확히 하였다고 볼 수 있다.

The aim of this thesis is to understand the protection law and the situation related with the trade secret piracy in Korea and in China. The trade secret piracy occurred in Korea is related with China, while the cases in China are domestic and mostly happened in Beijing, Guangdong, Shanghai, Jiangsu and Zhejiang. It is important to have common realization about the criminal situation and joint confrontation about the trade secret piracy between China and Korea in spite of the difference of the crime occurrence place and ways because the effective countermeasure of trade secret piracy is based on the mutual assistance of criminal matters between two countries. Futhermore, it is necessary to have consistent seminar or conference to understand the legal change and legal practice about trade secret protection between China and Korea for the continuous cooperation of the business and sustainable economic development through the interaction.
